KC Probation Department Sample PARENT/GUARDIAN NOTIFICATION

As the Parent/Guardian of a minor child, you are required by law to maintain effective parental control of your minor child at all times.  Failure to do so may result in a referral to the District Attorney requesting your prosecution for PC 272 Contributing to the Delinquency of a Minor.

California Penal Code Section 272 states:  Every Person who commits any act or omits the performance of any duty, which act or omission casuses or tends to cause or encourage or contributes to any person under the age of 18 years to come with the provisions of Welfare & Institutions Code 601 (Curfew; 4 or more truancies within one school year), or section 602 (violations of the law), or whose act or omission induces a minor to follow a course of conduct or to so live as would cause or tend to cause the minor to violate sections 601 or 602, isguilty of a misdemeanor punishable by up to 1 year in jail, and/or a fine of up to $2500.00, and up to 5 years probation. "For purposes of this section, a parent or legal guardian to any person under the age of 18 years shall have the duty to exercise reasonalbe care, supervision, protection, and control over their minor child."

You are required to:

  • Keep your child in your  home or in your immediate presence after curfew (10pm-5am)
  • Comply with your legal obligation to see that your child attends school each day, remains for the full time assigned, obeys all school rules and regulations, and maintains appropriate behavior.
  • Prohibit your child from violating (or) participating in the violation of any of the laws of the United States of America, or any State, County, or Municipality.
  • Prohibit your child from association with any gang(s) or gang members, (or) groups that associate for the purpose of engaging in criminal endeavors and engage individually or collectiviely in any criminal act.
