Definition of Homeless

According to the federal McKinney-Vento Homeless Education Assistance Act and California state law, the term “homeless children and youth” means “individuals who lack a fixed, regular, and adequate nighttime residence.”

This may include one or more of the following situations:
•   Sharing housing due to economic hardship or loss
•   Living in motels, hotels, weekly-rate housing
•   Living in public or private places not designed for sleeping (e.g. cars, campgrounds, parks, abandoned buildings, or on the street)
•   Living in substandard housing (i.e. without utilities, overcrowded, in disrepair) or trailer parks
•   Living in a shelter (family, domestic violence, or youth shelter) or other transitional housing program
•   Awaiting foster care or living with an adult who is not a parent or guardian
•   Enrolling as an unaccompanied youth, without a legal guardian
•   Migratory children and youth who meet the definition criteria

Incarcerated students are not considered homeless, even if their family is homeless.
They are part of the juvenile justice system and are subject to the requirements and regulations thereof.

Educational Rights

Qualified pre-school and school-aged children have the following rights under the federal McKinney –Vento Act and under California state law. They may:
•   Enroll immediately in school without having a permanent address, immunization records, or other school documents.
•   Continue to attend the school in which they were last enrolled or attend the school nearest their current residence.
•   Participate fully in all special programs and school activities for which they are eligible.
•   Receive transportation to and from school.
•   Qualify automatically for free and reduced-price lunches and other district food programs.
•   Contact the district liaison to resolve any disputes that arise during the enrollment process.

Parent Responsibilities

Before you move

•   Tell the teacher and principal that you are moving and give them the new address.
•   Ask for a copy of school records, including immunizations.
•   Contact the district Liaison for Homeless Education for help in enrolling your child in a new school or arranging for your child to continue in his/her current school.
•   Contact the school and provide any information you think will assist the teachers in helping your child adjust to new circumstances.

If You Move Often

•   Enroll children in school as soon as possible.
•   Keep a copy of birth certificates and school records.
•   Safeguard all health and immunization records.
•   Have a reliable person keep a second copy of these records.

Ask About Available School Services

•   Breakfast and lunch programs
•   Transportation
•   Special educational programs
•   Clothing and school supplies

Funding Opportunities

McKinney-Vento Grants: Education for Homeless Children and Youth
From CDE: The purpose of the program is to (1) facilitate the enrollment, attendance, and success in school of homeless children and youth; and (2) ensure homeless children and youth have equal access to the same free, appropriate, public education as provided to all other students. Services provided can not replace the regular academic program and must be designed to expand upon or improve services that are part of the school's regular academic program.

McKinney-Vento Homeless Education Act - District and School Responsibilities

It is the intent of the McKinney-Vento Homeless Education Assistance Act to ensure educational stability, continuity, and equity for families in transition. Under McKinney-Vento, the local school district provides the following support to eligible students.

District Liaison

All local educational agencies (LEAs) must have a district liaison to facilitate the implementation of the McKinney-Vento Homeless Education Assistance Act. (Click here for list of Kern County Liaisons.)

The Liaison ensures that:
•   Homeless children and youth are identified
•   Homeless students enroll in, and have full & equal opportunity to succeed in, the schools of the LEA
•   Homeless students have equal access to all school programs (e.g. GATE, Special Education, ELL programs, etc.)
•   Homeless students qualify automatically for Title I, School Meals, and After School Programs
•   Homeless families, children, and youth receive educational services
•   Parents or guardians are informed of educational opportunities available to their children
•   Public notice of the educational rights is disseminated (Posters and Brochures are available)
•   Enrollment disputes are mediated
•   Unaccompanied youth are immediately enrolled in school and are assisted in placement/enrollment decisions
•   Children and youth who do not have immunizations are assisted
•   Collaboration with appropriate state, community and school personnel occurs

Immediate Enrollment

•   Homeless children must be immediately enrolled.
•   “Enroll” and “enrollment” are defined to include attending classes and participating fully in school activities.
•   No prior records are needed, but should be obtained by the enrolling school as quickly as possible.
•   This includes birth certificates, social security numbers, immunization records, transcripts, and other records.
•   Unaccompanied youth have the right to enroll without a legal guardian.

Dispute Resolution

Whenever there is a disagreement the school must
•   Immediately enroll the student in school according to parent’s wishes
•   Keep the student until the dispute is settled
•   Provide transportation to the school of origin
•   Explain the decision in writing to parents
•   Contact the LEA Liaison to assist in settling the dispute with parents, guardian, or youth.
•   If the dispute is not resolved at the district level, the county liaison may be asked to facilitate communication.
•   If case is still not resolved, it will be referred to the state coordinator.

School Selection

•   Students have the right to stay in their “school of Origin” to the extent feasible* for the duration of homelessness, if it is in the best interest of the student and, if the parent requests.
•   “School of Origin” is the school the child attended when permanently housed OR when last enrolled.
•   Students can stay in their school of origin the entire time they are homeless and until the end of any academic year in which they move into permanent housing.
•   If a student is sent to a school other than that requested by a parent or guardian, the district must provide a written explanation to the parent or guardian of its decision and of their right to appeal

*Feasibility Criteria may include things like continuity of instruction, age of the child, safety of the student, length of stay in shelter, likely area in which family or youth will find permanent housing, student’s need for special instructional programs, impact of commute on education, school placement of siblings, schools attended by other children at the same shelter, and time remaining in the school year.

Transportation

•   Transportation must be arranged or provided, to and from the school of origin.
•   LEAs must provide or arrange transportation to and from the school of origin at the LEA homeless liaison’s request for unaccompanied youth.
•   If an LEA does not provide transportation to any of its students and it is determined that this placement is in the homeless student’s best interest, then the LEA is required to provide or arrange transportation for that student.
•   LEAs cannot use Title I or Title V funds to transport homeless students.
•   Once the student is permanently housed, the LEA may use Title I or Title V funds to continue transporting that student for the duration of the school year.

NOTE: School districts that provide transportation to and from the school of origin have documented an increase in attendance and achievement that resulted in an increase in funding to the districts.

Title I Requirements

Title I, Part A Reservation

The LEA will reserve Title I, Part A funds to provide comparable services to homeless children and youth to ensure that each homeless child and youth has equal access to the same free, appropriate public education, including preschool education, as provided to other children and youth. This reservation requirement is not formula driven. The amount reserved is to be determined by the LEA, as appropriate. The California Department of Education recommends reserving one percent off the top. [PL 107-110, Section 1113(c)(3)(A)]

Title I Requirements

•   Homeless children are by definition automatically eligible for Title I services.
•   Title I requires a set aside reservation to be placed in the Consolidated Application for categorical funding.
•   Identification data on homeless students is reported in the Consolidated Application.
•   Title I requires a description of the Title I services to be placed in the Consolidated Application and LEA Plan.
•   There are no anticipated changes to guidance except to reinforce the USDE position that homeless students must receive equal access to the same high academic standards in a mainstream setting.

What is CVIIS?
An Immunization Registry is a confidential computerized database that stores and tracks childhood immunization records and recommends dates when vaccinations are due.

The Central Valley Immunization Information System (CVIIS) is a regional effort of public health departments in Fresno, Kern, Kings, Madera, Mono, and Tulare Counties with the shared goal of increasing the rate of fully immunized children and reducing the number of unnecessary immunizations.

McKinney-Vento Connection
The McKinney-Vento Act gives homeless students the right to immediate enrollment, regardless of immunization status or records, and it requires LEA Liaisons to assist children in getting immunizations as needed. The California Health and Safety Code (Section 120440) permits designated school personnel read only access to immunization registry information.

Benefits of school participation in CVIIS include the following:
•   LEA personnel will have read-only access to immunization records from a growing list of providers.
•   LEAs will be provided with software training and a list of participating immunization providers.
•   LEAs that give immunizations on school sites may register as providers so that their information may be accessed by another school district when a student transfers.
•   There is no participation cost to the LEA.

School Participation
In order to become a CVIIS user, an LEA must sign an MOU regarding confidentiality and designated personnel must participate in a three-hour training on the software system (no cost to districts).

Single School Plan

Each school that operates programs funded through the Consolidated Application must develop a Single School Plan for Pupil Achievement as required by Education Code 64001. The California Department of Education has provided a single, comprehensive school plan template that meets the content requirements of EC 64001. Schools operating School-Based Coordinated Programs or School-Wide Programs may use this template with some additions/adaptations to meet the specific requirements of those programs. The template may also be used as the foundation for II/USP and High Priority Action Plans and CSRD plans with supplemental information as required by those specific programs.

County Co-op

The County Co-op was formed to coordinate some instructional services for small districts. The school districts involved in the Co-op are:

Belridge School District
Blake School District
ButtonwillowUnion School District
Caliente Union School District
Di Giorgio School District
Elk Hills School District
Linns Valley-Poso Flat School District
Maricopa Unified School District
Maple School District
McKittrick School District
Pond Union School District
Semitropic School District

Each of the small districts has the choice of participating in the Co-op. Services are provided for the Co-op by pooling the different funds each district receives in categorical programs. As a part of the Co-op, the Consolidated Application and the Local Improvement Plan are done as a consortium for the Co-op through the Kern County Superintendent of Schools Office.

About Categorical Programs

Categorical programs are a major component of district and site services. Federal and state categorical programs were created by the legislators to serve the special needs of students that are not covered by the general fund regular education programs. Each categorical program comes with its own program intent, rules, regulations, and exemplary practices.
